(NEW YORK)(November 21, 2008) For those of you who are not familiar with the peculiar highways and byways of the judicial process, welcome to the strange ways of the court system in Hawai'i. Apparently my lawsuit in a Honolulu state court has been dismissed.
Unfortunately, I have not seen a copy of the decision. Despite the significance of the court order, I was not given a courtesy notice when it was entered in Honolulu, apparently late Wednesday, although I was in Honolulu all day on Wednesday.
Thursday all day I was traveling back to New York and was unavailable. I did not get back to New York until 8:00 A.M. Friday.
I was alerted by a reader's e-mail that something had happened, and went to the Honolulu Advertiser's web site where I found a complete story,

Obviously I was unable to respond to phone calls while in the air, and when I checked my e-mails today the Advertiser reporter had not left a phone number to call him back.
The Court did not
fax my office a copy and so I have no immediate way of seeing a copy of the decision. I assume the Advertiser's news report is a fair summary of the decision.
Depending on what the response is to a fund appeal, I will certainly appeal this decision to the Hawai'i Intermediate Court of Appeals. The trial court's interpretation of the relevant statute appears to be a wooden reading of the law. The claim that there is a lack of historical significance to the birth certificate of a president of the United States is a classic example of how utter nonsense can exist in the judicial system... Thousands of people are jumping aboard a petition that demands documentation of President-elect Barack Obama's eligibility to hold the highest office in the U.S., not just assurances from party officials. Within only a few hours of its launch, more than 10,000 petitioners today had joined the effort coordinated by WND founder and editor Joseph Farah. A report accompany Farah's petition explains the many questions raised about Obama's eligibility, from an apparently fabricated "Certification of Live Birth" posted online to questions about what nation's passport he used during to travel to Pakistan.
The signature total was over 26,500 by late this evening.
As WND reported, one case is scheduled for a conference among U.S. Supreme Court justices Dec. 5. Former presidential candidate Alan Keyes and others filed a court petition in California asking the secretary of state to refuse to allow the state's 55 Electoral College votes to be cast in the 2008 presidential election until Obama verifies his eligibility to hold the office.
On Janet Porter's Faith2Action radio program today, computer specialist Ron Polarik left no doubt the image posted as Obama's "Certification of Live Birth" from the state of Hawaii was not genuine.
"Here's a smoking gun," he said. "Apparently Hawaii changes its borders [on documentation] every year. In 2007 it had a certain border, and it's got a 2007 border. However if you dig a little deeper you find it has a 2008 signature and seal," he said.
"Whomever did the forgery was not very clever," he said.

You've got to hand it to Philip J. Berg: he doesn't give up easily. You might recall that Philadelphia attorney Berg tried, and failed, to halt the presidential election of Barack Obama on the grounds that he is not a native-born citizen. Game over, right? Wrong.
Berg filed a writ of certiorari to the U.S. Supreme Court in late October, asking that the highest court review the decision of the U.S. District Court in Pennsylvania. The latter court dismissed Berg's claims because he lacked standing to bring them. Standing requires plaintiffs to prove they are directly affected by the issue at hand, with evidence of injury that is concrete and particular. In its decision the district court said Berg "does not, and we believe cannot, establish injury in fact." It also dismissed his claims as frivolous.
Berg takes this in stride. His writ, he says, requires Obama and the Democratic National Council to respond by December 1. Also, he has another arrow in his quiver. He's filed in the U.S. District Court in Washington, D.C., under the False Claims Act, which is often used in Medicaid fraud. "I am basing this on the fact that as a U.S. senator [Obama] is collecting money illegally because he is not a citizen of this country," he says.
One of the pillars of Berg's argument is that Obama doesn't have a legally-valid U.S. birth certificate because he was born in Kenya. Though debunking specialists from Snopes.com and Factcheck.org have asserted the validity of a birth certificate released by the Obama campaign and affirmed by the State of Hawaii, Berg remains unconvinced. Factcheck.org, he said, is suspect because it is run by a group called Annenberg of Chicago, where Obama once sat on a board with William Ayers. Not sure when this article was written so you may not have known about the lawsuit from Leo Donofrio (Donofrio vs Wells) that is currently in the US Supreme Court. Kenyan Ambassador to the United States, His Excellency Peter Ogego, admitted in this radio interview that Barack Obama was born in Kenya!
When WRIF "Mike In The Morning" Mike Clark (Michigan Radio Talk Show) Co-Host asked Kenyan Ambassador to the U.S., Peter Ogego: "One more quick question, president-elect Obama's birthplace over in Kenya, is that going to be a national spot to go visit where he was born?"
Kenya Ambassador Ogego replied: "It is already an attraction. His paternal grandmother is still alive."
Radio Co-Host asks again : "But his (Barack Obama's) birthplace, they will put up a marker there?"
Kenyan Ambassador Ogego replied : "It will depend on the government. It is already well known."
His Excellency Peter Ogego, Kenyan Ambassador to the United States admitted in this radio interview that Barack Obama was born in Kenya!
